General Business & Guarantee Conditions

Orders are regarded as assumed by BS Kinetics GmbH only if they have been confirmed by mail or a goods delivery has been carried out.

The following regulations exclusively apply to the contract if not something else, a certifiable written order confirmation, is agreed. The following business conditions are regarded as assumed with conclusion of the contract.

1. Deliveries
   Goods delivery is carried out only by pre-cash or cash on delivery plus the transportation costs flat rate. Bs Kinetics GmbH is authorised  to ask for an adequate payment in advance on special models and changes.
   
   
2. Retention of title
   The product remains property of Bs Kinetics GmbH until the completition of payment. If a third party takes access of the reserved product the customer has to point out that it is still property of BS Kinetics GmbH. If the customer behaves contrary to the contract, particularly delay in payment, BS Kinetics is allowed to take the reservation product back or to require assignment of the handing out claims against third parties if necessary.
   
   
3. Rescission
   The customers is entitled to recede from the contract by a written explanation if the confirmed delivery date is exceeded by at least four weeks. This does not apply if BS Kinetics GmbH is not responsible for the delay, particularly if the customer neglects his obligation to co-operate.
   
   
4. Liability
   The customer/ purchaser has to check immediately after receipt of the purchased contract goods/ workpiece, whether the delivered product is  acceptable and suitable for the designated purpose. Obvious defects and errors are to be complained within 14 days upon receipt of the product. Complains not in due time cannot be claimed. Bs Kinetics GmbH is entitled to correct/ repair the defects. Bs Kinetics GmbH also can take care of the problem by replacement or repurchase of the goods refunding the purchase price of their own choice. The legal guarantee rights are valid again after two times of amendment/ touching up. There is no liability of BS Kinetics for further damages to a third party or to other goods. Special models are excluded from the exchange.
   
   
5. Guarantee
   We accept a two years guarantee on all our products after receipt of the goods in case of manufacturing or material defects. The claims on the guarantee have to be shown in written form and the product and the guarantee certificate/delivering proof has to be presented. Problems caused by improper maintenance and also by wastage are not subject of the guarantee. The guarantee is dropped in case of damages caused by improper handling, especially by dropping down or pushing the goods, unauthorised dismantling of the case, leaked batteries, non-compliance of the instruction manual, improper care and maintenance of the equipment or damages on transit.
   
   
6. Place of jurisdiction
   The place of jurisdiction for all matters is 77855, Achern.
   Applicable is exclusively the laws of the Federal Republic of Germany.
   
   
7. End
   If one of the prominent clauses should be or become ineffective, the validity of the other clauses isn't touched. Then a regulation supercedes that suites to both parties most.
